Your use of the UPS Connect Website at www.upsconnect.com.au owned and operated by Unley Primary School (We, Our, or Us) is subject to:

• these Terms of Use (Agreement);
• Our Privacy Policy www.sa.gov.au/privacy
• any other terms, conditions, notices, or disclaimers displayed on the Website.

(collectively Website Terms).

We make the UPS Connect Website available to you on the terms and conditions set out in this Agreement. You must only use the UPS Connect Website in accordance with this Agreement.

By using the UPS Connect Website You will be deemed to accept the terms and conditions contained in this Agreement and agree to be bound by it.

Changes to the Website Terms

We may change the Website Terms from time to time by publishing an updated version to the UPS Connect website.

By continuing to use the UPS Connect Website, You will be deemed to have accepted the updated Website Terms and agree to be bound by them.

Website Access and Availability

We reserve the right to modify, discontinue, or disable all or part of the UPS Connect Website, on either a permanent or temporary basis, at any time. We will endeavour to provide You with reasonable prior notice of any modifications by posting on UPS Connect Website, however You accept it may not always be possible to provide prior notice.

We may suspend or terminate Your access to all or part of the UPS Connect Website at any time if You breach the terms of this Agreement in Our reasonable opinion.

Authorised Administrator and powers under these terms

We will appoint a person from time to time who will hold the ultimate responsibility for the management of UPS Connect Website (Authorised Administrator) and have all the relevant powers exercised by us which are outlined in this Agreement.

Website Use

The purpose of UPS Connect Website is to provide a business directory for the Unley Primary School Community where, provided you have a Relevant Connection with the Unley Primary School Community (as outlined below), you can post details of your business to the UPS Connect Website.

The information which is posted about businesses is available to be accessed by any parties worldwide including any relevant third party who chooses to use the website as a business directory. By accepting this Agreement, you agree that your details may be accessed by persons outside of the Unley Primary School Community. If you have a Relevant Connection with the Unley Primary School Community, you must also warrant that you: own the business in which you have posted on the UPS Connect Website; or have procured the relevant authority of an authorised person to the business to which you are employed and have posted on the UPS Connect Website.

What constitutes a Relevant Connection with the Unley Primary School Community?

You are deemed to have a (Relevant Connection) with the Unley Primary School Community if:

• you have a direct family member attending Unley Primary School (a direct family member includes: a son, daughter, grandson and/or granddaughter) and the direct family member must be currently attending Unley Primary School or have attended Unley Primary School in the last two years; or
• you are any other person that the Authorised Administrator or a sub-committee of the Governing Council deems to have a relevant connection with Unley Primary School Community.

Your information on UPS Connect Website will last for a period of one year unless it is updated and it can be removed by the Authorised Administrator for any reason it believes is appropriate (in its absolute discretion) including those outlined in this Agreement.

No Unlawful, Infringing or Offensive Activity

You must not post, transmit to or via the UPS Connect Website any information or content which breaches any laws or regulations, infringes a third party's rights or privacy or is offensive, defamatory or contrary to any relevant standards or codes, including generally accepted community standards. You must not permit or enable another person to do any of those things.

Examples of unlawful, infringing or offensive activity includes, but is not limited to, content that is:

• false or misleading, abusive, harassing, defamatory, offensive, humiliating, vulgar, obscene, pornographic, racist, discriminatory, or invasive of another's privacy;
• an infringement of the intellectual property rights of another party;
• is not owned by You;
• may encourage criminal activity;
• contravenes any applicable laws, regulations, codes and standards;
• disturbs or damages the UPS Connect Website or its content;
• damages Us or Our reputation; or
• otherwise breaches this Agreement.

The Authorised Administrator has the absolute discretion, including, without limitation to:

• accept posting of businesses;
• to remove businesses from the UPS Connect Website if:
• they do not consider a person to have a Relevant Connection with the Unley Primary School Community; or
• they reasonably consider that a person is implicating inappropriate, offensive, misleading or deceptive, defamatory, incorrect material or in any other way have breached this Agreement or any law or third party rights.

No Warranties

To the maximum extent permitted by law, We do not represent or warrant that the content on the UPS Connect Website is accurate, reliable, suitable or complete. The services which are outlined on the UPS Connect Website are not recommended by Us, Our staff or Our contractors. Accessing these services is solely your own personal decision. You also acknowledge that providing your business information on UPS Connect Website allows it to be accessed by a range of external third parties.

Our Liability to You

We exclude all liability for any loss or damage to the extent that it is caused by You.

To the maximum extent permitted by law, We are not liable for damage or loss of any kind arising in connection with Your access to, or use of, or inability to use, the UPS Connect Website (including but engaging a business on the UPS Connect Website).

Your Liability to Us

You agree to fully compensate and hold Us harmless for any loss, damage, costs, expenses and penalties arising out of Your material breach of this Agreement or any negligence, or any act of fraud by You or on Your behalf.

You are not liable to Us for any loss to the extent that it is caused by Us

The links are provided for Your convenience only, and do not indicate, expressly or impliedly, any endorsement by Us of the sites or the information, products, or services provided at those sites. You access those sites and use the information made available at those sites, solely at Your own risk.

UPS Connect Website and its contractors make no representation about the accuracy or suitability of the information or links provided on this website. The information is provided on an 'as is' and 'as available' basis, without express or implied warranty. You use the information and links at your own risk. We take no responsibility for the content of Internet sites that link from the UPS Connect Website.
